Harris & Harris Text-to-Pay Recurring Text Message Program Terms and Conditions
These Harris & Harris Text-to-Pay Recurring Text Message Program Terms and Conditions (“Terms and Conditions”) and Harris & Harris’ Privacy Policy, available on the Privacy Page, govern the Program (as defined below).
Program Description:
Harris & Harris, Ltd. (which includes for the purpose of these Terms and Conditions its agents and service providers and may be referred to as “Harris & Harris” or “H&H”) provides periodic text message updates and requests to consumers related to debts being collected by H&H that consumers may presently owe or may owe in the future (the “Program”). By opting in and/or providing your phone number to H&H or its clients in connection with an existing debt, you agree to receive periodic text messages. Messages are sent on a recurring basis and message frequency may vary.
How to Opt-Out:
You may reply STOP to any text we send you to opt-out. Once you opt-out, we will cease sending you text messages unless you opt-in again. Opting out of text messages will not opt you out of other text messages you may have elected or will elect to receive from us through a different telephone number. You may also opt-out by texting QUIT, END, CANCEL, or UNSUBSCRIBE.
Settings Reminder
: This is a friendly reminder that H&H does not dictate how text messages display on your phone or device, as those are elected by the user in the hardware settings and selections. If your texts are set up to display on your phone’s lock screen or through banners or similar alerts, you can choose to disable this through your device.

In case of questions, call (844)840-8062. You may also reply HELP to any text we send you to receive a text message with our name and a telephone number to which you may direct questions.
Supported Carriers:
Not all carriers may support our text message program.
Delivery:
We do not guarantee that you will receive any text messages under the Program. Circumstances beyond our control, including network issues, may result in your not receiving our text message. H&H is not liable for delayed or undelivered text messages.
Eligibility:
The Program is intended for use by U.S. residents who are at least 18 years of age.
Changes to Terms and Conditions:
We may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted on our website. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes.
Program Termination:
Harris & Harris reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Program, with or without notice.

California

California Consumer rights notification information: The state Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act require that, except under unusual circumstances, collectors may not contact you before 8 a.m. or after 9 p.m. They may not harass you by using threats of violence or arrest or by using obscene language. Collectors may not use false or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work. As required by law, you are hereby notified that a negative credit report reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations.
You may request records showing the following: (1) that Harris & Harris, Ltd. has the right to seek collection of the debt; (2) the debt balance, including an explanation of any interest charges and additional fees; (3) the date the debt became delinquent or the date of the last payment; (4) the name of the creditor and the account number associated with the debt; (5) the name and last known address of the debtor as it appeared in the creditor’s records prior to assignment of the debt; and (6) the names of all persons or entities other than the debt collector to which the debt has been assigned, if applicable. If you owe a debt to a hospital, the law requires that we wait at least 180 days from the date you were initially billed for the hospital services that are the basis of the debt before reporting adverse information to a credit reporting agency or filing a lawsuit.

You have the right to request all of the following concerning your debt:

NOTICE OF IMPORTANT RIGHTS. You have the right to make a written or oral request that telephone calls regarding your debt not be made to you at your place of employment. MEDICAL DEBTS: The following information is available and will be provided to you upon your request: the service date; amount and nature of all charges; whether the patient is verified as having health insurance; whether the health care facility screened the patient for programs that assist with health care costs; and whether the health care facility or third-party health care provider has billed or will bill insurance or public programs that may assist with health care costs for the services provided.
New York
Debt collectors, in accordance with the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq., are prohibited from engaging in abusive, deceptive, and unfair debt collection efforts, including but not limited to:
(i) the use or threat of violence;
(ii) the use of obscene or profane language; and
(iii) repeated phone calls made with the intent to annoy, abuse, or harass.

You also authorize us to resubmit any unsuccessful payment or correct any erroneous payment. You understand that your bank may charge a fee for any unsuccessful payment and that we have no liability for any such fee. You may cancel this Authorization by calling us at (844) 840-8062 or writing us at least three business days before you wish the cancelation to be effective. This Authorization in no way limits any right you may have under federal law to stop payment of a preauthorized electronic fund transfer by contacting your financial institution.
